OFFICIAL CONTEST RULES AND REGULATIONS

 

By entering this Contest, Entrants accept and agree to abide by these official contest rules and regulations (the “Rules”). The decisions of the Sponsor with respect to all aspects of the Contest are final and binding. Standard message and data rates may apply to participants who choose to participate in the Contest through a mobile device. Please contact your service provider for pricing and service plan information and rates before mobile device participation.

  1. This “An Okanagan Winery Experience For 2” Contest (the “Contest”) is sponsored by Mark Anthony Wine & Spirits, a division of Mark Anthony Group Inc. (the “Sponsor”) of 100 – 565 Great Northern Way, Vancouver, British Columbia V5T 0H8.
  1. To enter the Contest and be eligible for a chance to win a Prize a person (the “Entrant”) must be a legal resident of British Columbia who is at least 19 years of age at the time of entry. Persons are not eligible to enter if they: a) are an employee, director, agent or officer of the Sponsor or any of its affiliates or related parties, or of any of its advertising or promotional agencies, or of any participating stores or Contest judging organization or any prize supplier; b) are an employee of or contractor to any provincial liquor authority or any participating licensed establishment; or c) are a member of the immediate family (defined as parents, siblings, children, spouse and life partner, regardless of where they live) or household (whether related or not) of any of the above-referenced persons.
  1. CONTEST PERIOD. The Contest begins at 1:30:01 pm Pacific Time (“PT”) on February 27, 2025 and ends at 9:59:59 pm PT on March 1, 2025 (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible. Sponsor’s computer or networking equipment is the official time-keeping device for the Contest. 
  1. HOW TO ENTER: No Purchase Necessary. A purchase will not improve your chances of winning.

    To Enter: To obtain one (1) stamp card entry in the Contest (the “Stamp Card Entry”), (1) at the Vancouver International Wine Festival, visit one of our 11 participating Mark Anthony Wine & Spirits tables (collectively the “MAWS Tables” and each a “MAWS Table”) to receive a stamp card; (2) visit the MAWS Tables to collect the corresponding stamp for the stamp card; and (3) once the stamp card is completed, complete the entry form on the reverse of the stamp card in full and deposit the stamp card in specially-marked boxes available at the MAWS Tables. All fields on the entry form must be completed unless they are indicated as optional. When all required steps of the entry process are complete, you will automatically be eligible to earn one (1) entry in the Contest.

    Bonus Entry: To obtain one (1) bonus entry in the Contest (the “Instagram Entry”), (1) at the Vancouver International Wine Festival, take a picture with a MAWS Table (the “Photo”); (2) log into your non-private Instagram account (or create an account at www.instagram.com); and (3) post the Photo on your personal Instagram account and tag “@markanthonybc” using #MAWSatVIWF. When all required steps of the entry process are complete, you will automatically be eligible to earn one (1) entry in the Contest. For clarity, the Instagram entry is optional, and Entrants can only get an entry through Instagram after completing and submitting the stamp card.

    To ensure fairness, the number of entries is limited to one (1) Stamp Card Entry and one (1) Instagram Entry per person (collectively the “Entry” or “Entries”). For the purpose of these Rules, “Entry” includes an Entrant’s original submitted photo and any and all associated content, comments and material(s) (collectively, “Entry Materials”). Only eligible entries received during the Contest Period will be entered in the Contest.
  1. ENTRIES: To be eligible, all Entry Materials associated with your Entry must: (i) be publicly shared; (ii) not be deleted or altered during the Contest Period; (iii) be submitted and received in accordance with these Rules during the Contest Period; (iv) include all required Entry Materials, including required components/elements required in Rule 4; (v) be in accordance and compliant with these Rules, including, but not limited to, the specific Participation Requirements listed below in Rule 6; (vi) be in accordance and compliant with the applicable terms, rules, policies and guidelines of Instagram (the “Instagram Rules”), and (vii) be written in English (all as determined by Sponsor in its sole and absolute discretion).

    The same person cannot enter from two or more different e-mail addresses or Instagram accounts and two different persons cannot enter from the same e-mail address or Instagram account.

    Sponsor and the other Released Parties (as defined below) will not be responsible for illegible, falsified, damaged, lost, misdirected, mutilated, garbled, incomplete or late entries, which will be void. Any use of automated devices is prohibited. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Stamp Card Entry or one (1) Instagram Entry; (ii) use multiple names, identities, e-mail addresses, IP addresses, or Instagram accounts; (iii) use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; (iv) uploads inappropriate content; and/or (v) enter contrary to these Rules or to the Instagram Rules; then the Entrant may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. Anyone found “spamming” by posting multiple unrelated updates, comments or pictures unrelated to the Contest may be disqualified from the Contest. Only eligible entries received during the Contest Period will be entered in the Contest.
  1. PARTICIPATION REQUIREMENTS AND LICENSE.

    BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES (DEFINED IN RULE 9) WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, ANY PRIZES (INCLUDING ANY USE OR MISUSE OF ANY PRIZES).  THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES AND/OR THE INSTAGRAM RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZES.

    By participating in the Contest, each Entrant hereby warrants and represents that any Entry Materials submitted:

 

  • Complies with the Canadian Radio-television and Telecommunications Commission’s Code for Broadcast Advertising of Alcoholic Beverages and accompanying interpretation which can be found at: https://crtc.gc.ca/eng/television/publicit/codesalco.htm;
  • Do not refer to, include, or promote any form of alcohol consumption (e.g. bottles and glasses must be full and of legal serving size) or any form of irresponsible or illegal immoderate use of alcohol (i.e., no more than one standard serving per person);
  • Do not depict venues where consumption is prohibited (such as public places);
  • Are not targeted at or likely to appeal to an audience under the legal drinking age;
  • Do not contain any reference to or likeness of any identifiable third parties if they are under the legal drinking age in their jurisdiction of residence;
  • Do not contain any reference to or any image/likeness/voice of any identifiable third parties, unless consent has been obtained from all such individuals; if your entry does contain the likeness of any third party(ies), you represent and warrant to the Sponsor that you have obtained all necessary rights from all such persons to share their image online as part of your participation in the Contest and you agree to indemnify and hold harmless the Sponsor and the other Released Parties (as defined below) from and against any and all claims related, directly or indirectly, to your submission including, without limitation, claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related or other cause of action.
  • Do not associate consumption of liquor with driving a motorized vehicle, or with any activity that requires care and skill or has elements of danger;
  • Do not suggest any illegal sale, illegal purchase, illegal gift, illegal handling or illegal consumption of liquor;
  • Do not endorse, condone and/or discuss any illegal, inappropriate or risky behaviour or conduct;
  • Do not refer to, include, or promote any behaviour which may be considered antisocial, illegal or immoral;
  • Are original to him/her and that the Entrant has obtained all necessary rights in and to the Entry for the purposes of entering such Entry Materials in the Contest;
  • Have not been used for another Contest;
  • Do not and will not violate any law, statute, ordinance or regulation;
  • Will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party(including, without limitation, any competitors of Sponsor), or give rise to any claims for payment whatsoever; and
  • Are not defamatory, trade libelous, offensive, hateful, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
    • Alcohol/drug consumption or smoking;
    • Nudity;
    • Sexual activity or content;
    • Violence;
    • Crude, vulgar or offensive language and/or symbols;
    • Derogatory characterizations of any ethnic, racial, sexual or religious groups;
    • Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct;
    • Personal information of individuals, including without limitation, names and addresses (physical or e-mail);
    • Conduct or other activities in violation of these Rules;
    • Commercial messages, comparisons or solicitations for products or services;
    • Any identifiable third-party products and/or trade-marks, brands or logos. For example, any clothing worn by persons appearing in an Entry must not contain any visible logos, trade-marks or other third party materials;
    • URLs or links to any third party websites; and
    • Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the contest judges in their sole and exclusive discretion

      The Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) reserves the right to screen all Entry Materials. Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification. The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to request an Entrant to modify, edit and/or re-submit his or her Entry Materials (or any part thereof) in order to ensure that the Entry Materials comply with these Rules, or for any other reason. If such an action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Entry Materials (and therefore the corresponding Entry and/or the associated Entrant) – to ensure that the Contest is being conducted in accordance with the letter and spirit of these Rules.

      By entering the Contest and submitting an Entry, each Entrant: (i) without limiting the Instagram Rules, grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry Materials (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry Materials (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry Materials); and (iii) agrees to release and hold harmless the Released Parties (as defined below in Rule 9) from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry Materials (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related or other cause of action whatsoever.

 

  1. There is one (1) prize available to be won, which consists of an Okanagan Winery Experience for the winner and guest, which includes a winery tour at CedarCreek Estate Winery and lunch at CedarCreek Estate Winery’s award-winning Home Block restaurant (the “Prize”). The Prize is provided by the Sponsor. The approximate retail value of the Prize is three hundred fifty Canadian dollars ($350 CAD).

    Alcohol is not a part of the Prize. No more than the advertised number of prizes will be awarded. The Prize is non-transferable, must be accepted as awarded and cannot be substituted for cash, another prize or otherwise (other than at the sole discretion of the Sponsor). The Sponsor reserves the right, for any reason whatsoever, in its sole and absolute discretion, to award a substitute prize of equivalent monetary value or greater value if a prize cannot be awarded as described. All incidental costs and expenses not specifically referred to herein including (without limitation) federal, provincial and local taxes, shall be the responsibility of the prize winner. The Prize will only be released to the verified winner. Arrangements for Prize delivery will be confirmed with the winner by Instagram (direct message or tagged post), telephone or e-mail. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner.

    All travel must take place between March 11 to December 31, 2025 (or on such other dates as specified by the Sponsor in its sole and absolute discretion). Travel must be booked at least fifteen (15) days in advance. All arrangements relating to the Prize is the responsibility of the winner. Travel dates are subject to availability, blackout periods, government restrictions and regulations, and other restrictions may apply. The winner and his/her guest must travel on the same itinerary. Winner and guest are responsible for having all necessary documentation to permit travel and participate in the Prize, including government identification and/or passports, and all required COVID-19 documentation (including, without limitation, any required proof of vaccine documentation, proof of valid vaccine exemption documentation, and/or proof of negative COVID-19 test documentation). The winner and guest hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the trip. It is strongly recommended and encouraged that the Prize winner and his/her guest obtain sufficient personal travel and medical insurance prior to any Prize-related travel. The winner’s guest must be at least 19 years of age and complete a travel companion release form and any other documentation required by Sponsor before travel is booked. If the winner elects to participate in the trip without a guest, no additional compensation will be provided.

    Without limiting the foregoing, the following conditions apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor’s option; (iii) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the winner, including without limitation, airline baggage fees, gratuities, meals, transportation, excursions, in-room charges, personal expenses of any kind or nature, federal, provincial and local taxes, and any other incidental costs or expenses; (iv) if the winner does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (vi) all arrangements relating to the Prize is the responsibility of the winner; (vii) travel must be booked at least fifteen (15) days in advance; (viii) damaged, lost or stolen tickets will not be replaced; and (ix) by accepting the Prize, the winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.

    The Released Parties (as defined below) are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever), of any aspect of the Prize. Neither the winner, nor his/her guest, nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein. The winner and his/her guest will be solely responsible for complying with any and all COVID related and other protocols – including, but not limited to, mandatory vaccination, testing and/or screening requirements.

    None of the Released Parties (as defined below) makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prizes awarded in connection with the Contest. To the fullest extent permitted by applicable law, the winner understands and acknowledges that he/she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should the Prize fail to be fit for its purpose or is in any way unsatisfactory.
  1. WINNER SELECTION: A random draw will be conducted from all eligible Entries received during the Contest Period to select one (1) Entry on or around March 10, 2025 at 100 – 565 Great Northern Way, Vancouver, British Columbia V5T 0H8 by the Sponsor or its designated representative(s) (the “Contest Judges”). The Contest Judges will attempt to contact each selected Entrant by Instagram (direct message or tagged post), telephone or e-mail for a period of three (3) business days following the draw date. If a selected Entrant cannot be contacted within the allotted time, the Entrant is no longer eligible to win the Prize and the Sponsor may, at its sole discretion, select at random another eligible Entrant whom the Contest Judges will attempt to contact, and who shall in turn be subject to disqualification, in the same manner. The odds of being selected for a Prize depend on the total number of eligible entries received during the Contest Period.
  1. RELEASE AND SKILL-TESTING QUESTION: In order to be declared a winner, the potential winner must correctly answer, unassisted, whether mechanical or otherwise, an arithmetic skill-testing question; and the potential winner will be required to complete, sign and return to the Sponsor or its representative a Declaration of Compliance with the Rules and a Release of Liability and Publicity Release (“Declaration and Release Documents”) within three (3) business days of delivery of same by the Sponsor, confirming (among other things) compliance with the Rules and releasing the Sponsor, its advertising and promotional agencies, any Contest judging organization, the provincial liquor authorities, prize suppliers, parent companies and affiliates of all the foregoing and their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns (together the “Released Parties”) from any and all liability of any kind in connection with the Contest, or occurring as a result of the (i) participation in the Contest; (ii) acceptance of the prize as awarded; and (iii) the administration of the Contest and distribution of the prize awarded herein. The guest travelling with the winner will also be required to sign the Declaration and Release Documents. The winner and guest irrevocably authorizes, and gives its consent to, the Sponsor to broadcast, publish and disseminate his/her name, address, photograph, likeness or other image, voice and/or statements, in connection with any advertising, promotion, publicity, commercial or otherwise, and/or for general news, entertainment, marketing and information purposes, in any and all media without compensation (other than the Prize) of any kind or further notification. No Entrant will be declared a winner until his/her compliance with these Rules has been verified. Declaration and Release Documents must be signed and returned within the time period indicated on the documents or as requested by the Sponsor or its representative, or the Prize will be forfeited.

    If a potential winner: (a) fails to correctly answer the skill-testing question; (b) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (c) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then the Entrant will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible Entrant from among the remaining eligible Entries submitted and received in accordance with these Rules in accordance with the procedures outlined in Rule 8 (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).

 

GENERAL RULES

 

  1. The provincial liquor agencies are not in any way associated with this Contest nor are they liable in any way whatsoever in regard to any matter which relates to this Contest.
  1. The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to the Sponsor and not to Instagram. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy. Instagram is completely released of all liability by each Entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Instagram.
  1. The Contest is governed by the laws of Canada and the Province of British Columbia and each Entrant in the Contest hereby consents to the exclusive jurisdiction of the laws of British Columbia for any causes or controversies arising out of the Contest. Each Entrant waives any and all objections to jurisdiction and venue in these courts.
  1. By entering this Contest, each Entrant agrees to save and hold harmless the Sponsor and the other Released Parties from any and all liability for harm which the winner may suffer as a result of participation in the Contest, compliance or non-compliance with these Rules and acceptance and use of the Prize, and each selected Entrant winner agrees to sign the Sponsor’s form(s) of Declaration and Release Documents (see Rule 9 above) in this regard before receiving his/her Prize. The Released Parties shall not bear any liability arising from or in any way relating to the Contest or the Prize awarded.
  1. All Entries and Entry Materials are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor, including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry, Entry Materials or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.
  1. Entries may not be given or sold to anyone else, and the Sponsor reserves the right to refuse to accept the registration of an entry if the Sponsor considers the entry to have been submitted by an ineligible person or through any mechanical, electronic or other automated means of submission. All Entrants must prove their eligibility with valid photo identification and proof of residency, upon request.
  1. If the identity of an Entrant/winner is disputed, the Entrant/winner will be deemed to be the person in whose name the applicable e-mail and/or Instagram account is registered. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Sponsor’s computer or network equipment.
  1. All decision(s) of the Sponsor or others involved in the administration of the Contest, who may be employees of the Sponsor or its affiliates or independent contractors, are final and binding with respect to all aspects of the Contest, including, without limitation, eligibility and/or disqualification of entries. All entries are the property of the Sponsor.
  1. By entering the Contest, Entrants agree to abide by and be bound by these Rules and the Sponsor’s Privacy Policy available at: https://www.markanthonywineandspirits.ca/privacy-policy/. Entrants who have not complied with these Rules are subject to disqualification. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  1. Sponsor reserves the right to cancel or modify the Contest if fraud or any other factor impairs the integrity of the Contest as determined by Sponsor in its sole discretion. Without limiting the generality of the foregoing and subject to approval from any provincial liquor authority, if required, the Sponsor reserves the right, in its sole and absolute discretion, to cancel in whole or in part, and/or modify, amend or suspend this Contest and/or these Rules, in any way without prior notice or obligation, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any printing, administrative, technical or other error of any kind, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever or for any other reason whatsoever, as it as it deems appropriate based on the circumstances and/or to comply with applicable law or regulatory or other requirement. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all Entrants without right of appeal, including without limitation, any decisions regarding the eligibility/disqualification of entries. The Sponsor also reserves the right to alter the Contest Period, in the Sponsor’s sole discretion, subject to applicable notification requirements.
  1. By entering this Contest, each Entrant consents and agrees to the use by the Sponsor or its agents of such Entrant’s personal information for purposes of administering the Contest. By participating in the Contest, each Entrant agrees that all personal information collected by Sponsor (including that collected from selected Entrants in the course of Prize fulfilment) may be used in accordance with and subject to the Sponsor’s Privacy Policy available at: https://www.markanthonywineandspirits.ca/privacy-policy/
  1. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Website, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law, unless otherwise determined by the Sponsor, in its sole and absolute discretion.
  1. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

The Sponsor and the other Released Parties assumes no responsibility for lost, delayed, incomplete, garbled, undelivered, damaged or misdirected entries or for any technical problems of any kind affecting the operation or administration of this Contest, including, without limitation, any technical malfunction or failure of, or any other problem with, any computer hardware or software or any telephone network or lines or broadcast transmission during the Contest Period. The Released Parties will not be responsible for any injury or damage to the Entrant’s or any other person’s computer relating to or resulting from participation or downloading any materials in this Contest.
  1. This Contest is void where prohibited by law and is subject to all federal, provincial and municipal laws.
